GistMe

Terms of Use

DRAFT — effective on publication · Drafted 1 October 2026

These terms govern your use of GistMe, a voice-calling app published by Apex Root Solutions LLC ("we", "us"), a limited liability company organised under the laws of the State of Delaware, with its registered office in Wilmington, New Castle County, Delaware, and its principal place of business in Cedar Hill, Dallas County, Texas.

Emergency calls. GistMe is not a replacement for a mobile or landline telephone and cannot be used to call emergency services. Do not rely on it where you may need to reach emergency services.

1. Agreement

By creating an account or using GistMe you agree to these terms and to the Privacy Policy. You must be at least 13 years old (or older where local law requires).

2. Your account

Choose a unique username and keep your password and recovery code secret. You are responsible for activity on your account. Because we hold no email address or phone number for you, we cannot restore access if you lose both your password and recovery code.

3. Acceptable use

Do not use GistMe to harass, threaten or defraud anyone; to place unwanted calls or send spam invitations; to record a person without the consent the law requires; to break the law; to probe, disrupt or overload our systems or relays; or to circumvent blocks, rate limits or security. We may suspend or end accounts that do.

4. Calls, quality and data

Calls need an internet connection and use your data allowance; you are responsible for any charges from your carrier. Voice quality and availability depend on your network, device and settings. Ultra Saver mode favours low data and understandable speech over natural sound. We do not guarantee that a call will connect, ring on a locked or battery-restricted device, or be free of interruptions.

5. Recording

GistMe does not record calls. Laws on recording conversations vary; do not record other people using other tools without the consent the law requires.

6. Our rights and yours

GistMe and its software are owned by us and our licensors. We give you a personal, non-exclusive, non-transferable licence to use the app for its intended purpose. You keep your rights in your content (your display name and contacts). Open-source components are used under their own licences.

7. Termination

You may stop using GistMe and delete your account at any time in Settings. We may suspend or terminate access if you breach these terms or to protect users or the service.

8. Disclaimers and limits of liability

GistMe is provided "as is" and "as available", without warranties of any kind to the extent the law allows. To the extent the law allows, we are not liable for indirect, incidental, special or consequential damages, or for loss arising from missed or failed calls, and our total liability for any claim is limited to the greater of the amount you paid us for GistMe in the previous twelve months or US$50. Nothing here limits liability that cannot be limited by law.

9. Governing law and disputes

These terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. The state and federal courts located in Dallas County, Texas have exclusive venue over disputes arising from these terms or the service. Either party may seek injunctive relief in any competent court. Nothing in these terms displaces mandatory consumer-protection law of the place where you live.

10. Changes and contact

We may update these terms; if the change matters we will notify you in the app before it applies. Questions: support@apsoluts.com.
